Disclosure Obligations under Article 45 ISA (VAG)

Under Art. 45 para. 1 of the Insurance Supervision Act (VAG), we are required to inform you of the following as soon as we enter into contact with you:

  • our identity and address;
  • our activities as a broker and mandate holder, whereby we maintain a financially and economically independent relationship with insurance companies and commit to an exclusive duty of loyalty towards you as our client;
  • how you can obtain information about the professional qualifications of our employees and their education and continuing training;
  • who can be held liable for negligence, errors, or incorrect information in connection with brokerage activities;
  • the processing of personal data, in particular the purpose, scope, and recipients of the data, as well as their retention.

Form and Timing of Disclosure

The disclosure is provided in text form and is handed to you no later than when our brokerage activities commence.

Right of Withdrawal (Art. 2a VVG/ICA)

Under Art. 2a of the Insurance Contract Act (VVG), you have the right to withdraw from an insurance contract in writing within 14 days of acceptance of the application. The period begins upon receipt of the acceptance declaration. Withdrawal means the contract is deemed to have never been concluded.

Avoidance of Conflicts of Interest

As an independent insurance intermediary, we are financially and economically independent of insurance companies. We commit to disclosing any conflicts of interest and to basing our recommendations exclusively on the needs of our clients. Should a conflict of interest arise in a specific case, we will inform you in advance.

Liability

Solidwave Group AG is liable for damages caused by negligence, errors, or incorrect information in connection with brokerage activities. Liability is governed by the applicable statutory provisions. Professional liability insurance is in place.

Data Protection, Retention, and Rights of the Data Subject

1. Purpose and Scope of Data Processing

We process your personal data exclusively for the purpose of insurance brokerage, advisory services, contract administration, and the fulfillment of legal obligations. This includes, in particular, name, address, date of birth, contact details, health data (insofar as required for insurance brokerage), as well as financial and insurance data.

2. Recipients of Data

Your data is shared exclusively with the insurance companies necessary for obtaining quotes and concluding contracts, as well as, where applicable, reinsurers. Disclosure to other third parties occurs only with your express consent or where required by law.

3. Retention

Your data is retained for the duration of the mandate relationship and beyond in accordance with statutory retention periods (generally 10 years). After expiry of these periods, the data is deleted or anonymized.

4. Your Rights

You have the right to information about the personal data we process, to rectification of inaccurate data, to deletion (insofar as no statutory retention obligations exist), and to restriction of processing. To exercise your rights, please contact: service@solidwave.ch.

Disclosure of Compensation from Insurers

For the provision of our services, we may receive commission and/or administrative compensation paid by the insurer. These compensations are declared under the disclosure obligation per Art. 45b ISA (VAG) as follows:
